When clients set up a Trust, they will assign a "trustee", or a responsible party that will hold power over the "beneficiary" of that trust. Trusts can be structured in many different ways, but usually are set up with two beneficiaries. One that will receive money from the trust while the owner of the Trust is still living, and one which will receive the remainder of money from the Trust after the owner has passed.

Probate is a process in Estate Planning that ensures the appointed legal representative is given power to make decisions on behalf of the estate and will distribute the property of the estate to the proper beneficiaries.
